To confirm the Minutes of the meeting of the Planning Committee held on 15 March 2016


RESOLVED: that the minutes of the Planning Committee held on the 15 March 2016 be approved and signed by the Chairman

Apologies for non-attendance were submitted on behalf of Councillors J Ashley, B Bates, V Chapman, R Cope, I Ford, R Heseltine, H Lobuczek, R Perry, K Upton, D Williams and H Williams

3 Declarations of Interest

There were no declarations of interest


The Committee received a report of the Planning Officer – Minor Applications and Appeals requesting an extension of time for the completion of the Section 106 Agreement associated with planning application 15/00215/FUL explaining the reasons for such request.
1.  that the Team Leader – Minor Applications and Appeals be authorised to issue the decision on completion of a satisfactory section 106 Agreement to provide four affordable units on site and the agreed education contribution. 

2.  that in the event of the Section 106 Agreement not being completed by 31 May 2016, application 15/00215/FUL be refused on the grounds of affordable housing and education contribution.


The Committee received the report of the Director of Planning and Strategic Services, together with the schedule of replies to consultations on planning applications received after the agenda was prepared and prior to consideration of the planning applications.

15/01069/FUL - Grange Farm, Hollies Lane, Pattingham

Approved as recommended, with revised approved plans condition:

2. The development shall be carried out in accordance with the approved drawings numbered: 967/A/005 Rev A, received on 22nd March 2016 and 967/A/060 Rev C, received on 7th December 2016.

16/00038/FUL  - OCL, Hinksford Garden Centre, Hinksford Lane, Swindon 

Approved as recommended with revised wording to condition 7:

7. The premises shall be limited to the following opening hours:
1st of April until 1st of October: Monday to Friday 06:00-18:00
Saturday 08:00-16:00
Remainder of the calendar year: Monday to Friday 08:00-17:00
Saturday 09:00-16:00

The premises shall remain closed on Sundays and Public Holidays. No deliveries to the sites shall take place outside of these hours.
16/01069/FUL - 19 Watling Street, Churchbridge

Martyn Clews, the agent, spoke in support of the application

Councillor K Perry motioned for refusal on grounds of narrow access and space about dwellings issues. Councillor J Johnson seconded. The application was approved as recommended, subject to the following additional conditions:

7. The development hereby permitted shall not be brought into use until the access to the site within the limits of the public highway has been completed.

8. The access shall remain un gated.

9. The development hereby permitted shall not be brought into use until the access drive, parking and turning areas have been provided in accordance with the approved plans.

10. The development hereby permitted shall not be brought into use until the visibility splays shown on drawing No. 967/A/005 A have been provided. The visibility splays shall thereafter be kept free of all obstructions to visibility over a height of 600 mm above the adjacent carriageway level.

11. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (as amended), or any other subsequent equivalent order, no development within the following classes of development shall be carried out to the dwelling(s) hereby approved without the prior approval of the Local Planning Authority:

a. Schedule 2, Part 1, Class A - enlargement, improvement or other alteration
b. Schedule 2, Part 1, Class B - addition or alteration to the roof
c. Schedule 2, Part 1, Class C - any other alteration to the roof
d. Schedule 2, Part 1, Class D - porches
e. Schedule 2, Part 1, Class E - garden buildings, enclosures, pool, oil or gas storage container
g. Schedule 2, Part 1, Class G - chimney, flue or soil and vent pipe
h. Schedule 2, Part 1, Class H - microwave antenna
i. Schedule 2, Part 2, Class A - gate, wall, fence or other means of enclosure

Report added to agenda under Rule 25(c) of the Council Procedure Rules

The Committee received the report of the Team Leader (Minor Applications and Appeals), copy attached to the minutes.

RESOLVED: to delegate approval to the Team Leader of Minor Applications and Appeals not to defend the third reason for refusal relating to ecology, attached to application number 14/00906/FUL at Broad Lane, Essington, at the forthcoming public inquiry, as sufficient additional ecological information has now been submitted and to agree to remove reference to 'urban sprawl' from the second reason for refusal.
