Councillor M. Davies declared a disclosable pecuniary interest in Applications 15/01066/FUL and 15/00989/FUL. Councillor Davies withdrew from the meeting during consideration of the applications. Councillor L. Emery declared a non pecuniary interest in Application 15/00931/FUL as she lives in the vicinity of the development. Councillor L. Emery therefore withdrew from the meeting during consideration of the application

The Committee received the report of the Director of Planning and Strategic Services, together with the schedule of replies to consultations on planning applications received after the agenda was prepared and prior to consideration of the planning applications, the Committee heard representations from the persons below in respect of:

15/01066/FUL  18 Uplands Drive, Wombourne

15/01028/FUL - 10 Littlewood Road, Cheslyn Hay 
                        Mr D Onions (Agent) and Ms R Griffiths (Objector)

15/01126/FUL - 8 Dark Lane, Kinver 
                        Mr R Kitchen (Applicant)

15/01132/FUL - 1 Buttercup Close, Huntington

RESOLVED: that the planning applications detailed in the report be determined in accordance with the recommendations therein with the exception of the following items:

15/00931/FUL - Lodge Farm, Lodge Lane, Cheslyn Hay - Applicant - Mr N Piponides - PARISH - CHESLYN HAY

RESOLVED: that the application be refused on the following grounds:

1. The site is within the Green Belt and the proposed development is considered to be inappropriate development as set out in policy GB1 of the adopted Core Strategy. The development is therefore harmful to the Green Belt, contrary to policy GB1 of the adopted Core Strategy
 
2. The Local Planning Authority has considered the reasons advanced, but does not consider that these reasons constitute the very special circumstances required to justify inappropriate development in the Green Belt

3. The proposed development would have a detrimental impact on the amenity of the nearby residents contrary to policy EQ9 of the Core Strategy

4. The proposed development would have a detrimental impact on the rural character of the landscape contrary to policy EQ4 of the Core Strategy


15/01028/FUL - 10 Littlewood Close, Chesyln Hay - Applicant - Mr and Mrs Jason Ward - PARISH - CHESLYN HAY

RESOLVED: that the application be refused on the following grounds:

1.The site is restricted in size and the proposed development would be cramped in appearance and out of scale and character with adjoining properties, contrary to policy EQ11 of the adopted Core Strategy

2. The proposed development would have a detrimental impact on the amenity of the nearby residents in terms of loss of daylight and overbearing contrary to policy EQ9 of the Core Strategy


15/01069/FUL - Grange Farm, Hollies Lane, Pattingham - Applicant - Mr Nigel Bate - PARISH - PATTINGHAM AND PATSHULL

RESOLVED: that the application be deferred as clarification needed on openness. Applicant to explore alternative locations


15/01126/FUL - Land north of 8 Dark Lane, Kinver - Applicant - Mr R Kitchen - PARISH - KINVER

RESOLVED: that the application be approved subject to the following conditions:

1. The development to which this permission relates must be begun not later than the expiration of 3 years beginning with the date on which this permission is granted.

2. The development shall be carried out in accordance with the approved drawings: PL 006 PL 005 PL 004 received 23/12/2016.

3. Notwithstanding what is shown on the approved plans, before development commences, details of the facing materials to be used on the wall and roof of the development shall be submitted to the Local Planning Authority for approval. The development shall be carried out in the approved materials.

4. The development hereby permitted shall not be brought into use until the existing access to the site within the limits of the public highway has been completed.

5. The garage indicated on the approved plan shall be retained for the parking of motor vehicles and cycles. It shall at no time be converted to living accommodation without the prior express permission of the Local Planning Authority.

6. The development hereby permitted shall not be brought into use until the access drive, parking and turning areas have been provided in accordance with the approved plans.

7. Before the development commences details of all boundary treatment around and within the site shall be submitted to the Local Planning Authority for approval. The approved boundary treatment shall be built/erected concurrently with the development and shall thereafter be retained in the approved form and position throughout the life of the development.

8. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any other subsequent equivalent order, no development within the following classes of development shall be carried out to the dwelling, the subject of this approval, without the prior approval of the Local Planning Authority:
a. Schedule 2, Part 1, Class A - enlargement, improvement or other alteration
b. Schedule 2, Part 1, Class B - addition or alteration to the roof
c. Schedule 2, Part 1, Class C - any other alteration to the roof
d. Schedule 2, Part 1, Class D - porches
e. Schedule 2, Part 1, Class E - garden buildings, enclosures, pool, oil or gas storage
container
f. Schedule 2, Part 1, Class F - hard surfacing
i. Schedule 2, Part 2, Class A - gate, wall, fence or other means of enclosure
j. Schedule 2, Part 2, Class B - means of access

9. The hedge to the front of the plot and adjacent Dark Lane shall be retained for the lifetime of the development.

10. Before development commences details of the finished floor levels of the buildings shall be submitted to the Local Planning Authority for approval. The development shall be carried out to the approved levels.
