DETERMINATION OF PLANNING APPLICATIONS

The Committee received the report of the Chief Planning Officer, together with information and details received after the agenda was prepared.

17/00820/FUL – FALCONRY CENTRE AND PET ZOO, HALFPENNY GREEN VINEYARDS, TOM LANE, BOBBINGTON, STOURBRIDGE DY7 5EP -  APPLICANT – MR MARTIN VICKERS – PARISH – BOBBINGTON

Mr Zachary Hollinshead spoke for the application.

Mr Brian Taylor spoke against the application.

RESOLVED: that the application be approved subject to the following

 1.  Condition 2 should be amended to read ' within 3 months (and not 6) of the date of planning approval for the submission of a landscape scheme to the Local Planning Authority for approval

 2.  the inclusion of a further Condition 5:

The staged seating hereby approved shall be used only between the hours of 11:00am and 4:00pm, unless otherwise agreed in writing with the Local Planning Authority.

Reason

To ensure that the use of the staged seating does not detract from the reasonable enjoyment of surrounding residential properties in accordance with policy EQ9 of the adopted Core Strategy

RESOLVED: that this application be deferred for the following reasons.

1. to enable the Council to obtain a Counsel opinion on the pre-existing condition issue

2. to enable the Council to re-consult STW

3. to clarify the location of the steps leading down to the canal. Are the steps intended to stay in the curtilage of no. 3 or should they be within the curtilage of the new dwelling?
