16/01000/FUL – ESSINGTON BRICKWORKS SITE AT HOBNOCK ROAD, ESSINGTON, SOUTH STAFFORDSHIRE – APPLICANT- DX NETWORK SERVICES LTD – PARISH – ESSINGTON

After an extensive debate, Councillor Clifft motioned for refusal, this was seconded by Councillor Lever and it was

RESOLVED: that the Committee refuse the application for the following reasons:

1. The proposal represents inappropriate development within the Green Belt. No justifiable Very Special Circumstances have been demonstrated to clearly outweigh the harm by reason of inappropriateness and its harm upon the openness and permanence of the Green Belt; contrary to Core Policy 1 and GB1 of the adopted Core Strategy, and the National Planning Policy Framework

2. The proposal detrimentally impacts upon two of the five purposes of including land within the Green Belt and would cause encroachment into the countryside and would not assist in urban regeneration by encouraging the recycling of derelict and other urban land; contrary to Core Policy 1 and GB1 of the adopted Core Strategy, and the National Planning Policy Framework

3. The focus for economic growth, development and investment in South Staffordshire, in addition to the four freestanding Strategic Employment Sites, is the Main Service Villages identified in the settlement hierarchy in Core Policy 1 of the adopted Core Strategy. Essington is not one of the Main Service Villages identified in the adopted Core Strategy and accordingly the proposal would be contrary to Core Policy 7 of the adopted Core Strategy

16/00959/FUL – 1 OAK LANE COTTAGES, OAK LANE, CALF HEATH, WOLVERHAMPTON, WV10 7DR – APPLICANT – MR SHANE LEE – PARISH – HATHERTON

Councillor Ashley motioned for refusal, seconded by Councillor D Williams and it was

RESOLVED: that the Committee refused the application on the grounds that:

1. The proposal is within the Green Belt where there is a presumption against inappropriate development. Changes of use can be not inappropriate where they do not have a greater impact on the openness and visual amenities of the Green Belt. The conversion of this building to a dwelling would introduce a domestic curtilage with associated paraphernalia, which would have a detrimental impact on the openness and visual amenities of the Green Belt contrary to policy GB1 of the adopted Core Strategy

2. The information provided as part of the application does not sufficiently demonstrate that the building, subject of this application, is redundant and no longer required for the stabling of horses, therefore does not meet the requirement of policy EV6 of the adopted Core Strategy

3. The building subject of this application will require significant alteration to its fabric to bring it up to residential standards; therefore the proposal does not meet the requirement of policy EV6 of the adopted Core Strategy and would therefore be tantamount to a new dwelling

4. The development fails to satisfy the Council's Space about Dwellings standards in providing private amenity space to the rear of the proposed dwelling

5. The development would be within close proximity to the adjacent cattle farm which would cause harm to the amenity of any future occupants from noise and smell contrary to policy EQ9 of the Core Strategy

RESOLVED: that the Committee approve the application as recommended

16/00841/LBC – BROOKHOUSE FARM COTTAGE, ACTON HILL ROAD, ACTON TRUSSELL, STAFFORD ST170RY – APPLICANT – MR AND MRS PARROTT – PARISH – ACTON TRUSSELL, BEDNALL AND TEDDESLEY HAY
