RESOLVED: that the application be approved as recommended.

16/00392/FUL - 97 WALSALL ROAD, GREAT WYRLEY - APPLICANT: JOHN CLEE - PARISH: GREAT WYRLEY

RESOLVED: that the application be refused for the following reasons:

1.  The proposed development would cause overlooking and loss of privacy to neighbours contrary to policy EQ9 of the Core Strategy.

2. The proposed development would be out of keeping with the character of the existing area and would result in a reduction of amenity area at the site contrary to policy EQ11 of the Core Strategy.

RESOLVED: that the application be refused on the basis that the proposed development would have an impact on the character of the area and therefore be contrary to policy EQ11 of the adopted Core Strategy and on the basis that the National Planning Policy Framework encourages local authorities to resist inappropriate development of residential gardens.

RESOLVED: that the application be approved as recommended, subject to an amended condition 13: The development hereby permitted shall not be brought into use until the following off-site highway works details have been submitted to and approved in writing by the Local Planning Authority and constructed in accordance with the approved plans:

- erection of appropriate signage warning of pedestrians in carriageway

- SLOW traffic markings

- traffic priority road markings to give 'right of way'

- extension of existing footway into Dark Lane.

RESOLVED: that the application be approved subject to the following amended/additional Conditions:

2: The building hereby approved shall be used only for purposes directly related to equine.

3. Within 2 months of the date of this permission a landscape scheme must be submitted to and approved in writing by the Local Planning Authority (any scheme shall include the provision of protective fencing). The approved scheme shall be implemented and completed within 12 months of approval. Any failures shall be replaced within the next planting season and the scheme shall be maintained to the satisfaction of the Local Planning Authority.
